A 62-year-old man was arrested after allegedly sexually assaulting a Hooters waitress in Loveland.

An arrest affidavit states Todd Erdmann slapped the buttocks and grabbed the vaginal area of a waitress at the 4230 Byrd Drive store on Sept. 18. Video evidence from the store camera was submitted as evidence in the case.

The affidavit states that Erdmann called the waitress two days later and "repeatedly apologized' for the incident and claimed he was "drunk and embarrassed about the situation." He's being charged with a class 4 felony.

Hooters said Erdmann was an investor but "has no authority what so ever in this company. He has never been an officer, director, manager, or employee" despite previous media reports of him being an owner of the establishment.

Hooters representatives said Erdmann is banned from all locations and the establishment is investigating the incident.

"We are committed to providing a workplace that is free from harassment of any kind," a Hooters spokesperson said.

All suspects are innocent until proven guilty in the court of law. An arrest is merely an accusation of a crime by law enforcement.
