History was made yet again in Colorado during the 2022 election with the passage of a ballot measure concerning the legality of psychedelics.

Proposition 122 was one of the most debated ballot measures during the 2022 election in Colorado with the Associated Press officially calling the race on November 11, 2022, in favor of the measure. The Denver Post reports that opponents of the measure have also conceded.

About Proposition 122 in Colorado

Proposition 122 decriminalizes multiple psychedelics in Colorado and will, "create a state-regulated therapeutic system for safe, facilitated access to natural psychedelic medicine," according to NaturalMedicineColorado.

Some opponents of the measure believed that the passage of Proposition 122 meant the legalization of recreational sales of psychedelics, but that is incorrect.

Psychedelics will not be sold by retailers and will be regulated for therapeutic medical use.

Under Proposition 122, adults 21 and older could access psychedelic medicines that show promise in treating mental health conditions while under the guidance of a trained facilitator at designated and licensed healing centers, approved health-care facilities like palliative care, and in the comfort and safety of their own home.

Decriminalization of Psychedelics in Colorado

Passage of Proposition 122 will decriminalize the possession of certain psychedelics across Colorado to those ages 21 and over.

Denver was previously the only city in Colorado that had decriminalized the possession of psilocybin with I-301 in May 2019.

Which Psychedelics Are Legal Now in Colorado?

Until June 1, 2026, only Psilocybin and Psilocyn will fall under the natural medicine category covered in Proposition 122.

After June 1, 2026, the natural medicine board may recommend adding dimethyltryptamine (DMT), ibogaine, and mescaline (excluding peyote).

The only other state in America to legalize Psilocybin is Oregon, which did so in 2022 with Measure 109, along with decriminalizing all other drugs.
